Terms of Supply
These Terms and Conditions of Supply are the terms and conditions on which Defiance Combat/Guy Bloom will supply our
Products/Services listed on our website www.defiancecombatselfdefense.com (the "Products/Services") to you. Please read these terms
and conditions carefully before ordering Products/Services from our site. You should understand that by ordering any of the
Products/Services, you agree to be bound by these terms and conditions and if you do not accept these terms and conditions, you will not
be able to order the Products/Services from us. How The Contract Is Formed Between You And Us After placing your order, you will
receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been
accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such
acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the Dispatch Confirmation). The contract
between us (Contract) will only be formed when we send you the Dispatch Confirmation. Availability And Delivery Your order will be
fulfilled by the delivery date set out in the Dispatch Confirmation unless there are exceptional circumstances. Security All credit card
transactions on this site are processed using Secure Trading, a secure online payment gateway which encrypts your card details in a
secure host environment. Defiance Combat does not hold your credit card details on the website. To help ensure that your shopping
experience is safe, simple and secure, Defiance Combat uses external providers to take payment and process orders, we do this to utilise
current security technology via an up to date 3rd party. Payment We accept Visa, Mastercard, American Express, Delta, and Switch debit
cards. Prices include VAT but exclude delivery costs, which will be added to the total amount due at the amounts shown. Prices also
exclude any local duties and sales taxes outside the UK & EU for which a recipient may be liable. Upon receiving an order with a basket
value in excess of £5,000, we will request that you email us your details at info@defiancecombatselfdefense.com in order that we can
email to you our bank details and/or telephone you at a convenient time to discuss with you any queries you might have. The item/items
will then be reserved for you for a maximum of 5 working days. If the bank transfer is not received by us from you within 5 working days,
then the item/items will once again be made available for sale. Goods will not be dispatched until this transfer has been completed and
cleared funds have been received. Please note that the delivery address of a customer’s first transaction on Defiance Combat must be
the same as the customer’s billing address. Thereafter, that customer will be able to choose a delivery address different to that of the
billing address. Tracking A tracking number and a link to the relevant courier’s website will be emailed to you along with your dispatch
confirmation so that you may track the progress of your shipment. If you have any enquiries regarding your shipment, then please contact
us on info@defiancecombatselfdefense.com. You will be asked to sign for any goods delivered at which point responsibility for your
purchased goods passes to you. Our Refunds Policy For returns and exchanges requested within 7 days of delivery (with the exception of
certain items stated at point of purchase) we offer a free returns service via our international couriers DHL, Fedex or Parcelforce. All items
for return or exchange must have a Return Merchandise Authorization (RMA) number. RMA numbers can be obtained by emailing us at
info@defiancecombatselfdefense.com. Once received, your RMA number should be written on your original invoice and on the return-
shipping label (Air waybill slip). Please note that we do not accept liability for returned goods if you do not return them to us via the same
courier through whom the goods were originally shipped. We request that all goods are returned within 14 days of the date of your request
for an RMA. Returns received outside the above time frame are accepted at the discretion of Defiance Combat. We can only exchange an
item for the same item in a different size, subject to availability. We are unable to process any exchanges for a completely different item.
Exchanged items can only be dispatched after the returned goods have been received and undergone a quality control check. If you wish
to exchange an item, please email us your required size at info@defiancecombatselfdefense.com. Please note that any items returned
will NOT be refunded if they are not returned in their original condition or if they are not returned in all their original packaging. Please be
aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Community (EU). You
should make the goods freely available for collection by the relevant courier at a mutually convenient time within 14 days of receiving the
RMA. The return address is stated on the pre-printed shipping label supplied with your goods. We will usually refund any money received
from you using the same method originally used by you to pay for your purchase. We will usually process the refund due to you as soon
as possible and, in any case, within 30 days of the day we received your cancellation or the day we confirmed to you via e-mail that you
were entitled to a refund for delivery of the defective Product. Products/Services returned by you because of a defect will be refunded in
full, including a refund of the delivery charges for sending the item to you. Please note that items received as a gift that are returned may
only be refunded to the purchaser. Our Liability We warrant to you that the Product purchased from us is of satisfactory quality. Our
liability in connection with any such Product is strictly limited to the purchase price of that Product. We accept no liability for any loss of
income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office
time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence),
breach of contract or otherwise, even if foreseeable. Transfer Of Rights And Obligations The Contract between you and us is binding on
you and us and on our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of a Contract, or
any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or
otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract. Force
Majeure We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract
that is caused by events outside our reasonable control. Waiver If we fail, at any time during the term of a Contract, to insist upon strict
performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights
or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve
you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default.
Severability If any of these terms and conditions or any provisions of a Contract (including any provision in which we exclude our liability
to you) are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision
will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent
permitted by law. Entire Agreement These terms and conditions and any document expressly referred to in them represent the entire
agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or
arrangement between us, whether oral or in writing. We each acknowledge that, in entering into a Contract, neither of us has relied on
any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior
to such Contract except as expressly stated in these terms and conditions. Neither of us shall have any remedy in respect of any untrue
statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made
fraudulently) and the other party's only remedy shall be for breach of contract as provided in these terms and conditions. Law And
Jurisdiction The Contract will be governed by English law. Any dispute arising from, or related to, such Contract shall be subject to the
exclusive jurisdiction of the courts of England and Wales.
TERMS AND CONDITIONS WHERE DEFIANCE COMBAT IS ADVERTISING PRODUCT OWNED BY A THIRD PARTY SELLER
The Product that you wish to purchase is owned by a third party seller. You will need to contract directly with that third party seller for the
purchase of that Product. That contract will be formed through the purchase process on this site and you will be requested to confirm that
you have read, understood and accept that seller's terms and conditions of sale, during the purchase process. However, in relation to your
purchase of the Product from the third party seller, you are also required to agree to be bound by the following terms and conditions which
shall constitute a separate contract between you and Defiance Combat ("we" or "us"). Title to the Product Title to the Product will pass to
you at the time that you place your purchase order and commit to buy, in accordance with the third party seller's terms and conditions.
You hereby agree that title to the Product will then immediately be transferred from you to us as security until payment for the Product is
made by you. When you have made full payment of all sums due in respect of the Products/Services, including delivery charges, title to
the Product will then immediately be transferred back from us to you. Please note that we hold title as security only and we are not the
seller of the Products/Services to you. Title shall be transferred under these Terms and no further agreement or action by you or us is
required in order to transfer title to the Product from you to us or to transfer title to the Product back from us to you.
